A Chapter 7 Bankruptcy is the most common type of Bankruptcy filed in Georgia. It is referred to as a “clean-slate” or “Fresh-Start’ bankruptcy. It is called this because Chapter 7 Bankruptcy will wipe your slate clean of all unsecured debt (ex: Credit Cards, Medical Bills, Pay Day Loans, Personal Loans, balances owed on repossession or foreclosure, etc.).
People typically file Chapter 13 Bankruptcy usually fall into two categories:
-They make to much money in order to qualify to file a Chapter 7 Bankruptcy but make enough to pay back a portion of the debt they owe.
-They are behind on their monthly payments on their car loan or mortgage and need to add their back payments or arrears to the end of the loan in order to keep the property.
Filing under Chapter 13 stops lenders from foreclosing or repossessing your vehicle and gives you extra time to repay mortgage and car loan arrears.
